Likely hosting in someplace like Iceland or some other country that doesn't have very defined laws on the subject; places that are also very expensive to host in (either due to terrible hardware, or terrible bandwidth limitations).
That said, *pure legality* was not the core reason the site founders opted to ban certain content.
